NOTICE OF SALE UNDER POWER
PURSUANT TO AND IN ACCORDANCE WITH and UNDER AND BY VIRTUE of the power of sale and other rights, entitlements, and remedies contained in that Deed to Secure Debt (With Future Advance Clause) between (from) Deidre H. Grier (hereinafter referred to as the "Borrower") and (to) PrimeSouth Bank - Jesup (hereinafter referred to as the "Lender"), dated the 25th day of January, 2008 ("01-25-2008"), and recorded on or about the 19th day of February, 2008 ("02-19-2008"), in the Office of the Clerk of Superior Court of Wayne County, Georgia at Deed Book 34-J, Pages or Folio 258-262, the said PrimeSouth Bank will sell at public outcry, to the highest bidder for cash or certified funds, before the courthouse door of Wayne County, Georgia, within the legal hours of sale on the first Tuesday in September, 2017, the following described property (hereinafter referred to as the "Premises"): All of that certain tract or parcel of land situate, lying and being in land Lot 341 of the Third Land District of Wayne County, Georgia and bounded now or formerly as follows: On the Northeast by the mean low water mark of Altamaha River; on the Southeast by Lot 34; on the Southwest by access easement separating this lot from other lands of Eric Branch; and on the Northwest by lands now or formerly of Eric Branch. Said property is also shown as Lot #33 on a survey prepared by Everett Tomberlin, Georgia RLS #2922, dated March 22, 2006 and recorded in the Office of the Clerk of Superior Court of Wayne County, Georgia in Plat Book 44, Page 225. Reference to said plat is made for descriptive purposes with the exception of the boundary of the Altamaha River. Said boundary is and shall be the mean low water mark of the Altamaha River. Together with a permanent, non-exclusive easement for rights of ingress and egress over and upon that certain 30' easement shown on said plat and all other roads within Moss Landing Subdivision whether now existing or hereinafter created. Also conveyed herewith is the right to use and enjoy the community dock, pavilion and other common areas within said subdivision provided such use does not violate the terms and conditions of the Protective Covenants applicable to Moss Landing Subdivision, dated August 12, 2005 and being recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia in Deed Book 477, page 172. The said Deed to Secure Debt (With Future Advance Clause) secures the indebtedness now evidenced by that certain Promissory Note from Borrower, Deidre H. Grier, to the Lender, PrimeSouth Bank, dated 03-27-2006, and all renewals, additions, and extensions thereof, including, but not limited to, that Promissory Note dated 01-25-2008, and also including any other indebtedness of the Borrowers to the Lender that is actually secured by the said Deed to Secure Debt (With Future Advance Clause).
The debt and indebtedness secured by the said Deed to Secure Debt (With Future Advance Clause) and as shown in the underlying said Promissory Note, dated 03-27-2006, and all renewals, additions, and extensions thereof, including, but not limited to, that Promissory Note dated 01-25-2008, have been previously and are hereby again declared due and payable in full because of the failure to comply with certain terms and conditions of the said Deed to Secure Debt (With Future Advance Clause) and the said Promissory Note, dated 03-27-2006, and all renewals, additions, and extensions thereof, including, but not limited to, that Promissory Note dated 01-25-2008, and further, as consequence of the nonpayment thereof. Notice has been given of the acceleration of the indebtedness, and the intention to enforce provisions for collection of attorneys' fees and foreclosure in accordance with legal requirements and the terms of the said Deed to Secure Debt (With Future Advance Clause) and the said Promissory Note, dated 03-27-2006, and all renewals, additions, and extensions thereof, including, but not limited to, that Promissory Note dated 01-25-2008. Due to the indebtedness being and remaining in default, the sale will be made for the purpose of applying proceeds thereof for (1) the payment of the expenses of said sale; (2) the payment of the indebtedness secured by the Deed to Secure Debt (With Future Advance Clause), including accrued interest, attorneys' fees and any other sums secured by the said Deed to Secure Debt (With Future Advance Clause); and (3) the remainder, if any, shall be applied as provided by law and/or in accordance with the said Deed to Secure Debt (With Future Advance Clause). To the best of the knowledge of Lender, the Premises are in possession of the Borrower or those claiming by, through or under the Borrower. Consequently, the Premises will be sold as the property of the Borrower. The Lender as Attorney-in-fact for the Borrower will execute a deed under power of sale, or foreclosure deed, to the purchaser at or following said sale as provided in the Deed to Secure Debt (With Future Advance Clause) or as otherwise required by law. The Premises will be sold subject to (i) all unpaid taxes and assessments, if any; and (ii) all matters that would be disclosed by a current and accurate survey and inspection of the Premises, if any; and (iii) all senior and superior easements, senior liens or senior mortgages, senior limitations, restrictions, reservations, covenants, general subdivision restrictions and any other senior recorded encumbrances of record, if any. ADVERTISEMENT FOR BIDS
Sealed bids will be received for the Solar Array, Waste Water Treatment Plant, at Jesup City Hall until 10:00 A.M. (Local Time), September 12, 2017, at which time they will be publicly opened and read. There will be a Pre-Bid Conference at 10:00 A.M. (Local Time), August 29, 2017 at Jesup City Hall, 162 E Cherry Street, Jesup, GA 31598. This Pre-Bid Conference is not mandatory, but highly recommended. The work under this Contract shall be separated into two (2) divisions. Each division shall have its own contract. Contractors may bid on one or both divisions. The work will consist of the following: Division I - The site preparation for the Solar Array including clearing and grubbing, construction exit, check dams, silt fence, temporary grassing and all necessary appurtenances necessary for a complete job.
Division II - The construction of Solar Array at the Waste Water Treatment Plant, including maintenance of the silt fence, final grassing, chain-link fence, mounting system inverters, solar modules, mechanical and electrical installation, testing, commissioning and all appurtenances necessary for a complete job.
All work on the Project must be completed within 180 consecutive calendar days of date of notice to proceed. Bid shall be submitted on Bid Proposal Forms furnished for that purpose, in accordance with the Contract Documents and the Plans and Specifications which are on file and may be reviewed at the Jesup City Hall and the office of Georgia Solar Utilities, Inc, 4571 Arkwright Road, Macon, Georgia 31210. Copies of Bid Forms, Plans, Specifications and Contract Documents may be obtained from Georgia Solar Utilities, Inc, 4571 Arkwright Road, Macon, Georgia 31210, upon deposit of $200.00 per hardcopy set and $100.00 per digital format set. No refund will be made for returned documents. No bid will be considered unless sealed and filed with the City of Jesup prior to the time set forth above, and accompanied by a Bidder's Bond, payable to the City of Jesup, Georgia, for 10 percent of the amount of the bid; to be forfeited as liquidated damages in the event that the bid be accepted and the bidder fail to enter promptly into a written contract and furnish the required Payment Bond and Performance Bond (equal to 100% of the contract amount) and Insurance Certificates. Bids arriving after the designated time will be returned unopened.
No bids shall be withdrawn for a period of 60 days after the opening of bids. The City of Jesup reserves the right to reject any or all bids and to overlook and/or disregard informalities or irregularities in the proposals.

Reference to said plat is made for descriptive purposes with the exception of the boundary of the Altamaha River. Said boundary is and shall be the mean low water mark of the Altamaha River. All work on the Project must be completed within 180 consecutive calendar days of date of notice to proceed.
